Terms of Service

These terms govern use of Communications Assistant (“Naomi”), operated by David Kay (“we”, “us”, “our”). By using Naomi or opting in to SMS summaries, you agree to these terms.

1. Service description

Naomi is a personal AI phone assistant. When enabled by the operator, Naomi may join phone calls and, for participants who have separately opted in, send brief post-call SMS summaries. Naomi is not an affiliate marketing, lead-generation, or mass-promotional messaging service.

This section applies specifically to the optional SMS summary program and is separate from general use of the voice assistant.

Naomi is provided “as is” and “as available” without warranties of any kind.

6. Limitation of liability

To the fullest extent permitted by law, David Kay is not liable for indirect, incidental, or consequential damages arising from use of Naomi.

7. Third-party carriers and processors

SMS and voice delivery use telecommunications carriers and processors (including Twilio). Outages or carrier filtering may affect delivery. Processors act on our behalf to operate the service and do not receive your opt-in data for their own marketing.

8. Changes

We may update these terms; the effective date above will change when we do.

9. Governing law

These terms are governed by the laws of the State of Washington, USA.
